Electronic article on the law and legal system of Benin written by Noel Ahonagnon Gbaguidi who is Professor of Private Law and Director of the Ecole Nationale d'Administration and the Judiciary of Benin and William Kodjoh-Kpakpassou who is Judge at the Court of First Instance of Cotonou (Benin) and Associate Professor at the Ecole Nationale d'Administration and Magistracy of Benin. The article was published in 2009 (and updated by Gérard Aivo and Lazard H. Hounsa in 2019) on the Globalex website and made freely available by the Hauser Global Law School at the New York University School of Law. The article provides an introduction to the Republic of Benin, and an outline of the legal system, the Constitution and the Constitutional Court. The authors explain how Beninãs legal system is characterised by the coexistence of modern law (based on French law) and customary law. There is a description of key national laws and international laws that Benin is a party to. Information is also given on the court system and judiciary and on the roles played by the various legal professionals including judges, lawyers, bailiffs and notaries. The article is presented in French throughout.
