Chinese (PRC) & Hong Kong Law

This research guide to the Chinese (PRC) and Hong Kong Law systems is compiled by the University of Melbourne. On the introduction page, the guide includes various recommended sources for starting Chinese legal research. Also included are pages covering legislation, case law, treaties, books, journals & theses, law reform ,and news, all with a brief description, relevant links and materials, and often a section on how to go about finding more resources. As this guide is aimed at law students, it also includes a page on citing and referencing resources.

Hong Kong Treaties

Provided by the Hong Kong Legal Information Institute, this freely available database contains international agreements applicable to Hong Kong, in English and/or Chinese. Entries are grouped into Arrangements with the Macao SAR, Arrangements with the Mainland, Bilateral Agreements with Other Jurisdictions, and Treaties, then listed by year, category, or title. The HKLII Advanced Search facility has a filtering option for the Hong Kong Treaty Series. Pdfs in traditional Chinese are available on the Chinese version of the website, which can be accessed from the home page.

Department of Justice - External Affairs

External Affairs section of the Hong Kong Department of Justice website, which includes all the multilateral agreements in force and applicable to the Hong Kong SAR, and major bilateral and consular agreements which have come into force. The multilaterals are arranged by subject, and records are composed of the name, date in force, any relevant supplements, and a link to the text. The bilateral and consular agreements can be found under ‘Other Agreements’, and are arranged into agreement types.

IP Dragon

Edited by Dr. Danny Friedmann, a Hong Kong-based academic, this blog features commentary and information on intellectual property law in China. Includes a set of links to IP laws, regulations and court decisions from China , Hong Kong, Macau and Taiwan.

Legislative Council

Legislature of the Hong Kong Special Administrative Region of the People’s Republic of China. The website’s Council Meetings pages provide information about legislative proceedings and make available bills, draft subsidiary legislation, ordinances, subsidiary legislation, legislative papers and parliamentary questions from the current and two previous sessions. A large set of older materials – going back to 1884 - may be found on the Records of the Legislature pages.

Law Reform Commission of Hong Kong

Official site of the Law Reform Commission of Hong Kong, Special Administrative Region of the People's Republic of China. The Commission reviews aspects of the laws of Hong Kong referred to it by the Secretary of Justice or the Chief Justice. Members of the Commission, appointed by the Chief Executive, are listed on the site. The website carries online texts of published reports, consultation papers, implemented recommendations and matters under current consideration including double jeopardy, class actions and enduring powers of attorney.

Intellectual Property Department of Hong Kong

Website of the Intellectual Property Department of the Hong Kong Special Administrative Region. The site has information arranged under the following headings: trademarks; patents; design and copyright including laws, circulars, practical information for users and FAQs. There is also organisational information about the Department as a whole and notices from the Hong Kong Intellectual Property Journal relating to trademarks, patents and designs. There is background information on intellectual property and how to apply for registration in Hong Kong.

World Law: Hong Kong

Section of WorldLII (the World Legal Information Institute) covering websites relating to the Hong Kong Special Administrative Region (SAR) of the People's Republic of China. The links are arranged under categories such as Courts, Government, Law Reform, Legislation and Treaties and International Agreements, supported by an introduction to law for Hong Kong. Official website for the Law Society of Hong Kong, the professional association for solicitors in Hong Kong. The site has organisationsal information, committee details and annual reports of the Society and provides information on admission criteria and registration procedures.

Hong Kong e-Legislation

Database of Hong Kong ordinances, subsidiary legislation and constitutional instruments in Chinese and English, maintained by the Hong Kong Department of Justice. Has current and historical consolidated legislation from 30 June 1997 onwards, together with original legislation - as published in the Gazette - from 2000 onwards. Official verified pdf versions are gradually being uploaded and will eventually supersede the looseleaf Laws of Hong Kong.
